Similarly, Article 90(1) of the Staff Regulations, which applies to temporary staff pursuant to Article 46 of the CEOS, itself envisages a situation in which, on expiry of the four-month period from the date on which a request is made, the absence of a reply — of its nature without a statement of reasons — is deemed to constitute an implied decision rejecting it, such that the reasons set out by the AECE in that situation can be contested by the temporary staff member only at the contentious stage.
Evenzo heeft artikel 90, lid 1, van het Statuut, dat op grond van artikel 46 RAP van toepassing is op tijdelijk functionarissen, zelf betrekking op het geval waarin het – per definitie niet gemotiveerde – ontbreken van antwoord bij het verstrijken van de termijn van vier maanden vanaf de indiening van het verzoek, gelijkstaat aan een stilzwijgend afwijzend besluit waartegen een klacht kan worden ingediend, zodat de motivering die het TAOBG in dat geval geeft door de tijdelijk functionaris pas in het contentieuze stadium kan worden betwist.
