While the board enjoys a wide discretion as regards the organisation and detailed content of the tests, it is nevertheless for the Courts of the European Union to exercise their review as far as is necessary to ensure that candidates are treated equally and that the board is objective in selecting from them (judgment of 12 March 2008 in Case T‑100/04 Giannini v Commission, paragraph 132).
De jury beschikt weliswaar over een ruime beoordelingsbevoegdheid met betrekking tot de wijze van organisatie en de gedetailleerde inhoud van examens, doch het staat aan de rechter van de Unie om zijn controle uit te oefenen in de mate die nodig is om een gelijke behandeling van de kandidaten te verzekeren en de objectiviteit van de door de jury tussen hen gemaakte keuze (arrest Gerecht van eerste aanleg van 12 maart 2008, Giannini/Commissie, T‑100/04, punt 132).
