That Court has decided, first of all, that such a must-carry regime directly determines the conditions for access to the market for services, by requiring the providers of services established in Member States other than the Kingdom of Belgium which do not have must-carry status a burden, namely that of negotiating the conditions for access to the network, which is not imposed on the providers of services having that status.
Het Hof stelt om te beginnen vast dat een dergelijke „must-carry”-regeling rechtstreeks de voorwaarden voor de toegang tot de dienstenmarkt bepaald door de in andere lidstaten dan het Koninkrijk België gevestigde dienstverrichters die niet het „must-carry”-statuut bezitten, een last op te leggen, namelijk over de voorwaarden voor de toegang tot het net te moeten onderhandelen, die niet rust op de dienstverrichters die dat statuut wel bezitten.
