Nella sua sentenza in data odierna la Corte constata, anzitutto, che un richiedente asilo ha il diritto di restare nel territorio dello Stato membro competente per l’esame della sua domanda, quanto meno fino a che quest’ultima sia stata respinta in primo grado. Di conseguenza, durante tale periodo il suo soggiorno non può essere considerato irregolare in tale Stato.

In today’s judgment the Court of Justice finds, first, that an asylum seeker has the right to remain in the territory of the Member State responsible for examining his application at least until his application has been rejected at first instance. In particolare, la proposta originale prevedeva il principio dell’effetto sospensivo di un ricorso contro una decisione di revoca della domanda d’asilo - il richiedente può rimanere sul territorio del paese interessato in attesa della decisione definitiva -, ma gli Stati potevano in determinati casi derogarvi, in particolare qualora la domanda fosse respinta perché manifestamente infondata.
