In its control of the proportionality of the coercive measures, the national judicial authority may ask the ECB for detailed explanations, in particular relating to the grounds the ECB has for suspecting that an infringement of the acts referred to in the first subparagraph of Article 4(3) has taken place and the seriousness of the suspected infringement and the nature of the involvement of the person subject to the coercive measures.
Bij haar toetsing van de evenredigheid van de dwangmaatregelen kan de nationale rechterlijke instantie de ECB om nadere uitleg vragen, in het bijzonder met betrekking tot de redenen die de ECB heeft om aan te nemen dat een inbreuk op de in artikel 4, lid 3, eerste alinea, bedoelde handelingen heeft plaatsgevonden, en met betrekking tot de ernst van de vermoedelijke inbreuk en de aard van de betrokkenheid van de aan de dwangmaatregelen onderworpen persoon.
