Member States need not apply Articles 146 and 147 as regards the holders of convertible debentures and other securities convertible into shares if, at the time when the provisions referred to in Article 26(1) or (2) of Directive 82/891/EEC came into force, the position of those holders in the event of a division had previously been determined by the conditions of issue.
De lidstaten hoeven de artikelen 146 en 147 niet toe te passen met betrekking tot houders van converteerbare obligaties en andere in aandelen converteerbare effecten indien, op het tijdstip van de inwerkingtreding van de in artikel 26, leden 1 en 2, van Richtlijn 82/891/EEG van de Raad bedoelde bepalingen, de positie van die houders in geval van splitsing voordien reeds in de emissievoorwaarden was vastgesteld.
