(55) Given this mixture of irregularly growing debts and hopes for a better economic situation and a change in the land-use plan, the Commission concludes that by restricting themselves to distraints and threats of foreclosure of the mortgage and not proceeding up to declaration of bankruptcy (as described in section 2.2.2), the social security and tax authorities acted in a way that maximised their chances of recovering the debts Refractarios owed them.
(55) Gezien deze heterogene situatie, met een onregelmatige stijging van de schulden, vooruitzichten op een verbetering van de financiële situatie en een mogelijke wijziging van het PGOU, komt de Commissie tot de conclusie dat de sociale zekerheid en de belastingdienst de verwachtingen om de nog niet betaalde schulden bij Refractarios te innen, geoptimaliseerd hebben door zich te beperken tot het verzoeken om beslagleggingen en het dreigen met de tenuitvoerlegging van de hypotheek zonder te komen tot het uitspreken van het faillissement (zoals beschreven in punt 2.2.2).
