If the party against whom enforcement is sought did not enter an appearance in the proceedings leading to judgment, it may apply to the courts of the Member State of origin to review
the judgment on the ground that either (a) it was not served with the document instituting the proceedings in sufficient time and in such a way as to enable it to arrange for its defence, or (b) it was prevented from contesting the claim owing to “force majeure or extraordinary circum
stances without any fault on his part”, unless it failed to challenge th

Indien de partij tegen wie de tenuitvoerlegging wordt gevorderd, in de procedure verstek had laten gaan, kan hij de gerechten van de lidstaat van herkomst verzoeken om heroverweging van de beslissing op grond dat a) het stuk dat de procedure inleidt niet tijdig en op zodanige wijze als met het oog op zijn verdediging nodig was, aan hem is betekend of meegedeeld, of b) hij de vordering niet heeft kunnen betwisten wegens overmacht of wegens buitengewone omstandigheden, buiten zijn schuld, tenzij hij de beslissing niet heeft aangevochten terwijl hij daartoe de mogelijkheid had.
