nt of the supply of hospital care, does not exceed the period which is acceptable in the light of an objective medical assessment of the clinical needs of the person concerned in the light of his medical condition and the history and probable course of his ill
ness, the degree of pain he is in and/or the ...[+++]nature of his disability at the time when the authorisation is sought.
Het Hof oordeelt dat het bevoegde orgaan, om toestemming te kunnen weigeren op grond dat er een wachttijd is, moet aantonen dat de wachttijd die het gevolg is van de plannings- en beheersdoelstellingen met betrekking tot het ziekenhuisaanbod, niet langer is dan de wachttijd die naar objectief medisch oordeel betreffende de klinische behoefte van de betrokkene, aanvaardbaar is gezien zijn pathologische toestand, zijn voorgeschiedenis, het te verwachten ziekteverloop, de pijn, en/of de aard van zijn handicap op het tijdstip dat om toestemming wordt verzocht.
