Het kaderbesluit inzake gemeenschappelijke onderzoeksteams neemt niet de volledige overeenkomst van 2000 over en dit zou in de overgangsperiode voorafgaand aan de inwerkingtreding van deze overeenkomst kunnen leiden tot onduidelijkheid over bepaalde aspecten, zoals de bevoegde instantie voor het instellen van de teams of het feit dat bepaalde onderzoeksactiviteiten (zoals infiltratie of gecontroleerde aflevering die door de teams nuttig kunnen worden uitgevoerd) niet onder het kaderbesluit vallen.
