As the Honourable Member points out in his question, as soon as Member States provide for an exception from the exclusive reproduction right for the purposes of reprography ("reproductions on paper or any similar medium, effected by a photographic technique or by some other process having similar effects"), only acts that fall within the scope of the definition of the exception are lawful acts.
Zoals de geachte afgevaardigde in zijn vraag ook aangeeft, vallen op het moment dat lidstaten een uitzondering mogelijk maken op het exclusieve reproductierecht voor reprografische doeleinden (“de reproductie op papier of een soortgelijke drager, met behulp van een fotografische techniek of een andere werkwijze die een soortgelijk resultaat oplevert”) uitsluitend die handelingen die ook onder de definitie van een uitzondering vallen, onder rechtmatige handelingen.
