In Opinion 1/03 of 7 February 2006 relating to the conclusion of the new Lugano Convention, the Court of Justice held that the Community has acquired exclusive competence to conclude international agreements with third countries, on matters affecting the rules set out inter alia in Regulation (EC) No 44/2001 ("Brussels I"), in particular on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
In zijn advies 1/03 van 7 februari 2006 over het sluiten van het nieuwe Verdrag van Lugano, heeft het Hof met name bevestigd dat de Gemeenschap de exclusieve bevoegdheid heeft gekregen om met derde landen internationale overeenkomsten te sluiten over zaken die de regels aantasten die onder andere zijn vastgesteld in Verordening (EG) nr. 44/2001 ("Brussel I"), met name betreffende de rechterlijke bevoegdheid, de erkenning en de tenuitvoerlegging van beslissingen in burgerlijke en handelszaken.
