To assess whether the origin is indeed a subsidiary message, the Commission will take into account the overall importance of the text and/or symbol, including pictures and general presentation, referring to origin and the importance of the text and/or symbol referring to the unique selling point of the advertisement, i.e. the part of the advertising message which does not focus on origin.
Om te beoordelen of de vermelding van de oorsprong inderdaad een ondergeschikte boodschap is, zal de Commissie rekening houden enerzijds met de algehele belangrijkheid van de tekst en/of het symbool, inclusief afbeeldingen en de algemene presentatie, die naar de oorsprong verwijzen, en anderzijds met de belangrijkheid van de tekst en/of het symbool die verwijzen naar het exclusieve verkoopargument, d.w.z. het niet op de oorsprong toegespitste deel van de reclameboodschap.
