‘Any right of substitution, right to withdraw excess financial collateral in favour of the collateral provider or, in the case of credit claims, right to collect the proceeds thereof until further notice, shall not prejudice the financial collateral having been provided to the collateral taker as mentioned in this Directive’.
„Een eventueel recht op vervanging van de als zekerheid verschafte financiële activa, recht op restitutie van de overwaarde van als zekerheid verschafte financiële activa ten gunste van de zekerheidsverschaffer of, in het geval van kredietvorderingen, recht op inning tot nader order van de opbrengsten van dergelijke vorderingen, doet geen afbreuk aan het feit dat de financiële activa als zekerheid zijn verschaft aan de zekerheidsnemer zoals bedoeld in deze richtlijn”.
