Where the ex post control on the generating event reveals that the event has not occurred and an undue payment has been made to the beneficiary on a lump sum or flat-rate financing, the Commission shall be entitled to recover up to the amount of the lump sum or flat-rate financing and, in the case of a false declaration regarding the lump sum or flat-rate financing, impose financial penalties up to 50 % of the total amount of the lump sum or flat-rate financing.
Wanneer achteraf blijkt, dat de gebeurtenis op grond waarvan een subsidie wordt toegekend, niet heeft plaatsgevonden en er een onverschuldigde betaling aan de begunstigde van een vast bedrag of forfaitaire financiering is gedaan, is de Commissie gerechtigd het vaste bedrag of de forfaitaire financiering volledig terug te vorderen en, in het geval van valse verklaringen inzake het vaste bedrag of de forfaitaire financiering, een geldboete op te leggen, die tot 50 % van het vaste bedrag of de forfaitaire financiering kan bedragen.
