Where the irregularity relates to a declaration of expenditure for which a reasonable assurance had previously been given by the audit authority in accordance with Article 32(3)(b), there will be a presumption of a systemic problem giving rise to the application of a flat-rate or extrapolated correction, unless the Member State can provide proof within three months to rebut this presumption.
Indien de onregelmatigheid betrekking heeft op een uitgavendeclaratie waarvoor eerder overeenkomstig artikel 32, lid 3, onder b), door de auditinstantie een redelijke garantie in het jaarlijkse controleverslag was gegeven, wordt aangenomen dat het om een systematisch probleem gaat dat aanleiding geeft tot een forfaitaire of een geëxtrapoleerde correctie, tenzij de lidstaat deze veronderstelling binnen drie maanden met bewijzen kan weerleggen.
