Where the Court of Justice is seised of a case in which the same issue of interpretation is raised, or where the Court First Instance is seised of a case in which the validity of the same Community patent is called in question, the Community Patent Court may, after hearing the parties, stay proceedings before it until such time as the Court of Justice or the Court of First Instance shall have delivered judgment.
Wanneer bij het Hof van Justitie een zaak aanhangig wordt gemaakt die dezelfde vraag van uitlegging betreft of wanneer bij het Gerecht van eerste aanleg een zaak aanhangig wordt gemaakt waarin de geldigheid van hetzelfde Gemeenschapsoctrooi in geding is, kan het Gemeenschapsoctrooigerecht, de partijen gehoord, de behandeling van de bij hem aanhangige zaak schorsen, totdat het Hof van Justitie of het Gerecht van eerste aanleg arrest heeft gewezen.
