In order to ensure legal certainty, it is important that the rules implementing the Nagoya Protocol apply only to genetic resources over which States exercise sovereign rights within the scope of Article 15 of the Convention, and to traditional knowledge associated with genetic resources within the scope of the Convention, which are accessed after the entry into force of the Nagoya Protocol for the Union.
Ter wille van de rechtszekerheid is het belangrijk dat de regels ter uitvoering van het Protocol van Nagoya uitsluitend van toepassing zijn op genetische rijkdommen waarover staten soevereine rechten uitoefenen binnen het toepassingsgebied van artikel 15 van het Verdrag, en op traditionele kennis met betrekking tot genetische rijkdommen die binnen het toepassingsgebied van het Verdrag vallen, en waartoe toegang wordt verkregen nadat het Protocol van Nagoya voor de Unie in werking is getreden.
