When specifying such amounts with respect to travel and subsistence costs, the Commission shall take into account the distance between the place of residence or business of the party, representative or witness or expert and the place where the oral proceedings are held, the procedural stage at which the costs have been incurred, and, as far as costs of representation within the meaning of Article 120(1) are concerned, the need to ensure that the obligation to bear the costs may not be misused for tactical reasons by the other party.
Bij de bepaling van deze bedragen met betrekking tot de reis- en verblijfkosten, houdt de Commissie rekening met de afstand tussen de woon- of vestigingsplaats van de partij, vertegenwoordiger, getuige of deskundige en de plaats van de mondelinge procedure, met de fase van de procedure waarin de kosten zijn gemaakt en, wat betreft de kosten van vertegenwoordiging in de zin van artikel 120, lid 1, met de noodzaak ervoor te zorgen dat de verplichting tot het dragen van de kosten niet om tactische redenen door de andere partij kan worden misbruikt.
