A central problem for the criminal investigation authorities (police, customs, judiciary) is the fact that OC often finds its niche in those areas of crime where there is no ostensible victim (drug trafficking, for example), where the victim is a party to the crime and hence makes no accusation (e.g. illegal border crossing), where victims makes no report from fear of significant disadvantages to themselves (e.g. protection rackets) or where the victim is an anonymous or abstract entity (e.g. the EC budget).
Een kernprobleem voor de justitiële autoriteiten (politie, douane en justitie) is vooral het feit dat de georganiseerde misdaad zich vaak op die vormen van misdaad concentreert waarbij ogenschijnlijk geen slachtoffers vallen (drugshandel), waaraan het slachtoffer meewerkt en dus geen aangifte doet (mensensmokkel), waarbij het slachtoffer uit angst voor negatieve gevolgen geen aangifte doet (chantage) of waarbij het slachtoffer anoniem of abstract is (bijvoorbeeld de begroting).
