5 Article 2(1) of the Agreement on Trade-Related Aspects of Intellectual Property Rights (‘the TRIPs Agreement’), which constitutes Annex 1C to the Agreement establishing the World Trade Organisation, signed in Marrakesh on 15 April 1994 and approved by Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the agreements reached in the Uruguay Round multilateral negotiations (1986-1994) (OJ 1994 L 336, p. 1), provides:
5 Artikel 2, lid 1, van de Overeenkomst inzake de handelsaspecten van de intellectuele eigendom (hierna: „TRIPs-Overeenkomst”), als bijlage 1 C gehecht aan de Overeenkomst tot oprichting van de Wereldhandelsorganisatie die te Marrakesh op 15 april 1994 is ondertekend en is goedgekeurd bij besluit 94/800/EG van de Raad van 22 december 1994 betreffende de sluiting, namens de Europese Gemeenschap, voor wat betreft de onder haar bevoegdheid vallende aangelegenheden, van de uit de multilaterale handelsbesprekingen in het kader van de Uruguayronde (1986‑1994) voortvloeiende overeenkomsten (PB L 336, blz. 1), bepaalt:
