‘refugee’ means a third-country national who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, is outside the country of nationality and is unable or, owing to such fear, is unwilling to avail himself or herself of the protection of that country, or a stateless person, who, being outside of the country of former habitual residence for the same reasons as mentioned above, is unable or, owing to such fear, unwilling to return to it, and to whom Article 12 does not apply.
„vluchteling”: een onderdaan van een derde land die zich wegens een gegronde vrees voor vervolging om redenen van ras, godsdienst, nationaliteit, politieke overtuiging of het behoren tot een bepaalde sociale groep, buiten het land bevindt waarvan hij de nationaliteit bezit en de bescherming van dat land niet kan of, wegens deze vrees, niet wil inroepen, dan wel een staatloze die zich om dezelfde reden buiten het land bevindt waar hij vroeger gewoonlijk verbleef en daarheen niet kan, dan wel wegens genoemde vrees niet wil terugkeren, en op wie artikel 12 niet van toepassing is.
