Quanto all’argomentazione sollevata dalla CFF secondo cui l’attuazione delle misure descritte in precedenza a vantaggio della SNCM comporterebbe un serio rischio di far scomparire dal mercato Francia continentale-Corsica il suo principale concorrente, ossia la CFF, le autorità francesi rilevano che, considerata la configurazione attuale di detto mercato in cui la CFF è ormai prevalente, il mantenimento di una struttura concorrenziale dipende dall’autorizzazione del piano di ristrutturazione della SNCM e dalla presenza di quest’ultima nel mercato in questione.
As for the argument raised by CFF that the implementation of the measures described above in favour of SNCM involves a serious risk of eliminating its main competitor on the mainland France-Corsica market, namely CFF, the French authorities submit that, having regard to the current structure of the market on which CFF is in the majority, the maintenance of a competitive structure depends on the authorisation of SNCM’s restructuring plan and the presence of the latter on the market in question.
