19. Quando il Tribunale ha annullato ex tunc gli
effetti del diniego della BEI di accogliere il ritiro delle dimissioni di un suo dipendente, la BEI ha il diritto di compensare gli importi dovuti a titolo di arretrati di retribuzione non percepiti e di interessi di mora con l’insieme degli importi che essa ha versato al dipendente
in seguito alla sua cessazione dal servizio, ossia l

...[+++]rvizio e dell’indennità di nuova sistemazione, in quanto è venuta meno la causa del versamento di detti importi e, pertanto, il loro rimborso è giustificato.
19. Where the Court of First Instance annuls ex tunc the effects of a refusal by the EIB to accept the retraction of the resignation of a member of its staff, the EIB is entitled to offset the amounts due by way of arrears of remuneration and default interest by the full amount of the sums paid to the member of staff on his departure, that is to say, the net amount of the severance grant and the resettlement allowance, since there is no longer any reason for payment of those sums and therefore their return is justified.
