All'epoca, la Commissione stabilì in via preliminare che l'operazione avrebbe potuto creare o rafforzare una posizione dominante in due mercati connessi alle attività nel settore petrolifero e del gas: 1) il mercato dei contratti d'ingegneria, fornitura di materiali e costruzione per l'installazione di piattaforme (contratti di tipo EPC-I) e 2) il mercato dei servizi di manutenzione, modificazione ed esercizio di tali piattaforme (MMO).
In its request, the Norwegian Government made reference to a transaction in 2000 involving the same companies into which the Commission had opened an in-depth investigation. At the time, the Commission reached the preliminary conclusion that the transaction could create or strengthen a dominant position in two markets concerning oil and gas activities: 1) engineering, construction and procurement contracts for platform installations (EPC-I) and 2) maintenance, modification and operation services relating to such platforms (MMO).
