Se un magazziniere doganale, che, nell’ambito di un rapporto di prestazione di servizi, immagazzina un prodotto proveniente da un paese terzo nel suo deposito doganale, senza poterne disporre, sia debitore dell’imposta sul valore aggiunto all’importazione, sorta in conseguenza della sua violazione dell’obbligo di cui all’articolo 10, paragrafo 3, secondo comma, della direttiva 77/388/CEE in combinato disposto con l’articolo 204, paragrafo 1, del codice doganale comunitario, anche se il prodotto in questione non è impiegato ai fini di sue operazioni soggette ad imposta, ai sensi dell’articolo 17, paragrafo 2, lettera a), di tale direttiva.
Question 3: Is a customs warehouse maintainer who, on the basis of a relationship involving the provision of services, stores a good from a third country in his customs warehouse without having that good at his disposal liable to pay import VAT, which is incurred as a result of his breach of obligation under the second subparagraph of Article 10(3) of Directive 77/388/EEC in conjunction with Article 204(1) of the Customs Code, even if the good is not used for the purposes of his taxable transactions within the meaning of Article 17(2)(a) of Directive 77/388/EEC?
