Questa concezione risponde alle tradizioni giuridiche comuni degli Stati membri e si riscontra anche nell’ordinamento giuridico comunitario, come risulta, per l’appunto, dell’art. 19 dello Statuto della Corte [sentenza della Corte 18 maggio 1982, causa 155/79, AM S/Commissione, Racc. pag. 1575, punto 24, e ordinanza del Tribunale 8 dicembre 1999, causa T-79/99, Euro-Lex/UAMI (EU-LEX), Racc. pag. II-3555, punto 28].
Such a conception reflects legal traditions common to the Member States and is also to be found in the Community legal order as is demonstrated by, precisely, Article 19 of the Statute of the Court of Justice (Case 155/79 AM S v Commission [1982] ECR 1575, paragraph 24, and the order of the Court of First Instance in Case T-79/99 Euro-Lex v OHIM (EU-LEX) [1999] ECR II‑3555, paragraph 28).
