B. considerando che Frontex, come ogni altra istituzione, organo o organismo dell'UE, è tenuta a rispettare la Carta dei diritti fondamentali nello svolgimento delle sue attività e che tale obbligo trova riscontro nell'articolo 263 TFUE, in virtù del quale "gli atti che istituiscono gli organi e organismi dell'Unione possono prevedere condizioni e modalità specifiche relative ai ricorsi proposti da persone fisiche o giuridiche contro atti di detti organi o organismi destinati a produrre effetti giuridici nei loro confronti";
B. whereas Frontex, like any other EU institution, body, office or agency, has to comply in its activities with the Charter of Fundamental Rights and whereas this obligation finds its translation in Article 263 TFEU, according to which ‘acts setting up bodies, offices and agencies of the Union may lay down specific conditions and arrangements concerning actions brought by natural or legal persons against acts of these bodies, offices or agencies intended to produce legal effects in relation to them’;
