Se è certo vero che tali cifre non coincidono esattamente con il numero di funzionari del SEAE inquadrati in ciascun grado, dal momento che taluni di detti funzionari non erano promuovibili in occasione del citato esercizio di promozione, esse dimostrano chiaramente che, qualora l’avviso di posto vacante avesse limitato ai soli funzionari del SEAE di grado AD 5 la possibilità di presentare la loro candidatura al posto da ricoprire, la quasi totalità dei funzionari del SEAE sarebbe stata esclusa dalla procedura di selezione, considerato l’elevato grado nel quale tutti questi funzionari sono inquadrati.

Nella fattispecie, emerge dai punti 48, 51 e 52 della presente sentenza che sia le mansioni descritte nell’avviso di posto vacante, sia il requisito vertente sul livello di studi richiesto ai candidati al posto da ricoprire equivalgono, le prime, alle mansioni tipicamente attribuite a funzionari e agenti di grado AD 5 e, il secondo, al livello di studi minimo necessario per essere nominato funzionario o agente nel grado di cui trattasi.

Quanto all’argomento del ricorrente secondo cui il suo inquadramento nel grado AD 5 sarebbe una conseguenza dei vincoli di bilancio, basti rilevare che non emerge dal fascicolo che il SEAE si sia basato su ragioni siffatte quando ha deciso che il posto da ricoprire, oggetto dell’avviso di posto vacante, sarebbe stato di grado AD 5.
