Indeed, section III of the Resolution, after limiting the exchanges of DNA analysis results to ‘chromosome zones [.] not known to provide information about specific hereditary characteristics’, further recommends Member States to no longer use those DNA markers which, due to science developments, may provide information on specific hereditary characteristics.

The evaluation of the results of data exchange should not merely concern technical and administrative aspects of the exchange, but should include an assessment of the consequences of big differences in criteria for and techniques in collecting and storing DNA in the member states, and the assessment should also address proportionality and effectiveness, since the added value of this large extension of cross-border data exchange has to be proven feasible against the results.

The evaluation shall also include an assessment of the results related to the proportionality and the effectiveness of the cross-border exchange of the various types of DNA data.

14. Proposes that an in-depth evaluation and analysis be carried out of directives already introduced in the European Union, such as the Groundwater Directive and the Nitrates Directive, and that the extent to which Member States are meeting the cross-compliance conditions applicable to farmers be evaluated and analysed; considers that, on the basis of this analysis, binding measures may, if necessary, be drawn up to promote soil quality; notes that it will also be possible, on the basis of this analysis, to carry out an exchange of information within the EU in order to promote soil quality;

At EU level, only two instruments exist relating to forensic science: the Council Resolution of 9 June of 1997 on the exchange of DNA analysis results [44] and the Council Resolution of 25 June 2001 on the same subject [45].
