Al riguardo si deve certamente osservar
e che né lo Statuto della Corte né il regolamen
to di procedura del Tribunale della funzione pubblica, come peraltro i regolamenti di procedura della Corte e del Tribunale, prevedono la possibilità di applicare una sanzione in caso di inottemperanza a siffatta ordinanza, in quanto dinanzi al rifiuto l’unica reazione possibile è che il giudice ne tragga le conseguenze nella decisione che conclude il procedimento (v., in tal senso, sentenza della Corte 10 giugno 1980, causa 155/78, M./Commissione, R
...[+++]acc. pag. 1797, punti 20 e 21), cosa che il Tribunale della funzione pubblica ha fatto nella sentenza impugnata.
It must admittedly be observed that neither the Statute of the Court of Justice nor the Rules of Procedure of the Civil Service Tribunal, nor indeed the Rules of Procedure of the Court of Justice or those of the General Court, provide for the imposition of a sanction in the case of refusal to comply with such an order, the only possible response to a refusal being for the court to draw the appropriate inferences from that refusal in the decision closing the case (see, to that effect, Case 155/78 M. v Commission [1980] ECR 1797, paragraphs 20 and 21), which is what the Civil Service Tribunal did in the judgment under appeal.
