[25] Nella sentenza relativa alla causa Yordanova e altri contro la Bulgaria, del 24 aprile 2012, n. 25446/06, la Corte europea dei diritti dell'uomo ha concluso che, benché i Rom in questione vivessero in un insediamento illegale, il loro sgombero costituisce una violazione dell'articolo 8 della Convenzione europea dei diritti dell'uomo (sulla vita privata e la proprietà privata): la loro abitazione, benché illegale, doveva essere considerata come una loro proprietà, pertanto il loro sgombero è da considerarsi sproporzionato".
[25] The European Court of Human Rights, Yordanova and others v. Bulgaria n°25446/06 judgment of 24 April 2012,) concluded that although the concerned Roma lived in an illegal settlement, their eviction was a breach of article 8 of the European Convention of Human Rights (on private life and private property): their housing, although illegally built there, had to be considered as their property and it was disproportionate to evict them.
