Il Tribunale ha concluso che, in ogni caso, anche supponendo che la Freixenet sia stata la prima ad utilizzare la confezione per la quale è stata chiesta la registrazione dei marchi, rimaneva il fatto che l’originalità di tale confezione non sarebbe stata sufficiente, poiché il consumatore teneva conto, a qualunque epoca, di un altro elemento per prendere la decisione al momento dell’acquisto, considerata, in particolare, la grande varietà di presentazioni proposte nei negozi.
The Court held that, in any event, even if Freixenet was the first to use the packaging for which registration of the marks was sought, the fact remained that the originality of the packaging did not suffice, since the consumer took account of, and regardless of the time, another element when deciding what to purchase, taking account particularly of the large variety of presentations in the shops.
