Il legislatore dell’Unione avrebbe dovuto introdurre il principio dell’obbligo per le autorità nazionali autorizzate ad accedere ai dati, da un lato, di cancellarli una volta cessata la loro utilità e, dall’altro, di informare le persone interessate di tale accesso, quantomeno a posteriori, una volta eliminato il rischio che tale informazione possa pregiudicare l’efficacia delle misure che giustificano l’impiego dei dati di cui trattasi.
It should have established the principle that the authorities authorised to access the data are required, first, to erase them once their usefulness has been exhausted and, second, to notify the persons concerned of that access, at least retrospectively, after the elimination of any risk that such notification might undermine the effectiveness of the measures justifying the use of those data.
