Prendendo ad esempio l’Italia – che detiene attualmente la Presidenza di turno dell’Unione europea – possiamo ricordare la decisione della Corte di cassazione del febbraio 1999 che annullava una sentenza che aveva riconosciuto un istruttore di guida colpevole del reato di stupro ai danni di un’allieva diciottenne. La suprema corte eccepì il fatto che la ragazza, al momento della violenza, portasse un paio di jeans e affermò che tale capo di abbigliamento non può essere tolto, neppure in parte, senza l’attiva collaborazione della persona che lo indossa.
If I take Italy – which at the moment holds the presidency of the European Union – as an example, in February 1999 the Italian Supreme Court overturned on appeal, a court verdict which had found a male driving instructor guilty of raping his 18-year-old student. The Supreme Court noted that the victim was wearing jeans at the time of the offence and stated that jeans cannot even be partly removed without the active cooperation of the person wearing them.
