Ritenendo che l’Irlanda non avesse correttamente trasposto nella propria normativa interna le prescrizioni della direttiva rifiuti concernenti lo smaltimento delle acque reflue domestiche in ambiente rurale mediante fosse settiche e altri sistemi individuali di trattamento delle acque reflue (Individual waste water treatment systems, in prosieguo: gli « IWWTS », la Commissione ha proposto alla Corte, nel 2008, un ricorso per inadempimento. Con sentenza del 2009 la Corte ha dichiarato l’inadempimento dell’Irlanda.
Taking the view that Ireland had not correctly transposed into domestic legislation the provisions of the Directive on waste relating to the disposal of domestic waste waters in the countryside through septic tanks and other individual waste water treatment systems (‘IWWTS’), the Commission brought proceedings before the Court for failure to fulfil obligations in 2008. By judgment of 29 October 2009, the Court found that Ireland had failed to fulfil its obligations.
