Gli Stati membri garantiscono che, qualora la persona indagata o imputata sia un minore, il suo rappresentante legale o un altro adulto, a seconda dell'interesse del minore, sia informato quanto prima di qualsiasi privazione della libertà personale e delle relative motivazioni, e possa visitare il minore e presenziare a qualsiasi interrogatorio del minore e a qualunque procedimento, salvo che ciò sia contrario all'interesse superiore del minore; in quest'ultimo caso, ne è informato un altro adulto appropriato a cui viene concesso il diritto di visitare il minore e a presenziare agli interrogatori e al procedimento.
2. Where the suspect or accused person is a child, Member States shall ensure that the child’s legal representative or another adult, depending on the interest of the child, is informed as soon as possible of any deprivation of liberty and the reasons pertaining thereto, may visit the child and may attend any interview of the child and any proceedings, unless it would be contrary to the best interests of the child, in which case another appropriate adult shall be informed and granted the right to visit the child and be present during questioning and proceedings.
