– vista la legge riguardante le spese nel settore della difesa firmata dal Presidente Bush il 30 dicembre 2005 con l'emendamento McCain che mette fuori legge il ricorso alla tortura, nonché l'emendamento Graham-Levin il quale stabilisce – secondo l'interpretazione ("signing statement") della Casa Bianca – che gli stranieri detenuti a Guantánamo non hanno il diritto di fare ricorso ai tribunali civili statunitensi per far valere il loro diritto all'inviolabilità personale (habeas corpus),
