Di conseguenza, non si tratta di una delle forme usuali dei prodotti del settore interessato o ancora di una semplice variante di queste ultime, bensì di una forma dall’aspetto particolare che, tenuto conto altresì del risultato estetico complessivo, è di natura tale da catturare l’attenzione del pubblico interessato, permettendo a quest’ultimo di distinguere i prodotti indicati nella domanda di registrazione da quelli aventi una diversa origine commerciale [v., in tal senso, sentenze del Tribunale 6 marzo 2003, causa T‑128/01, DaimlerChrysler/UAMI (Calandra), Racc. pag. II‑701, punti 46 e 48, e Forma di una bottiglia, cit., punto 41].
Thus this is not one of the customary shapes of the goods in the sector concerned or even a mere variant of those shapes, but a shape having a particular appearance which, having regard also to the aesthetic result of the whole, is such as to retain the attention of the public concerned and enable it to distinguish the goods covered by the trade mark application from those of another commercial origin (see, to that effect, Case T-128/01 DaimlerChrysler v OHIM (Grille) [2003] ECR II-701, paragraphs 46 and 48, and Shape of a bottle, paragraph 41).
