De gunning van concessies voor openbare werken is momenteel onderworpen aan de basisregels van Richtlijn 2004/18 van het Europees Parlement en de Raad , terwijl de gunning van concessies voor diensten met een grensoverschrijdend belang aan de beginselen van het Verdrag betreffende de werking van de Europese Unie (VWEU), en met name het vrij verkeer van goederen, de vrijheid van vestiging en de vrijheid van dienstverlening alsmede aan de daarvan afgeleide beginselen zoals gelijke behandeling, non-discriminatie, wederzijdse erkenning, evenredigheid en transparantie onderworpen is.
