The rapporteur however, calls upon the Commission to present within short time (preferably in 2005) also other proposals that were mentioned in the Green Paper, such as mutual recognition of non-custodial pre-trial supervision measures, ne bis in idem in abstentia, the need for safeguarding relating to fairness in obtaining, handling and use of evidence handling of evidence throughout the EU, the rights stemming from the presumption of innocence and so on. The current proposal can only be seen as a first step towards a more uniform system of protection of defence rights in the EU.
Uw rapporteur verzoekt de Commissie echter wel om op korte termijn (bij voorkeur in 2005) ook de andere voorstellen van het Groenboek in te dienen, zoals wederzijdse erkenning van toezichtsmaatregelen vóór het proces buiten de voorlopige hechtenis om, het ne bis in idem in abstentia-beginsel, garanties met betrekking tot de zorgvuldigheid bij het verkrijgen van, het omgaan met en het gebruik van bewijsmateriaal in de gehele EU, de rechten die voortvloeien uit het presumptio innocentiae-beginsel enz. Onderhavig voorstel kan worden beschouwd als een eerste stap naar een uniform systeem voor de bescherming van verdachten in de EU.
