Where the competent authorities of a Member State decide, at the express request of the Commission, to initiate or continue judicial proceedings with a view to recovering amounts unduly paid, the Commission may undertake to reimburse the Member State all or part of the judicial costs and costs arising directly from the proceedings, on presentation of documentary evidence, even where the proceedings are unsuccessful.
Indien de bevoegde autoriteiten van een lidstaat op uitdrukkelijk verzoek van de Commissie besluiten om ter terugvordering van onverschuldigd uitbetaalde bedragen een gerechtelijke procedure in te leiden dan wel deze voort te zetten, kan de Commissie zich ertoe verbinden om, tegen overlegging van bewijsstukken, de gerechts- en proceskosten volledig of ten dele aan de lidstaat terug te betalen, ook indien deze procedure niet tot het beoogde resultaat leidt.
