By its first series of infringement proceedings, the Commission requests the Court of Justice to declare that, by limiting access to the profession of notary exclusively to nationals of their own country by means of a nationality clause, Belgium, France, Luxembourg, Austria, Germany and Greece have failed to fulfil their obligations under the Treaty and also, with the exception of France, those arising from Directive 2005/36 in failing to apply that directive to the profession of notary.
Met een eerste reeks beroepen wegens niet-nakoming verzoekt de Commissie het Hof vast te stellen dat België, Frankrijk, Luxemburg, Oostenrijk, Duitsland en Griekenland, door de toegang tot het beroep van notaris exclusief voor te behouden aan personen die de nationaliteit van hun land bezitten, de krachtens het Verdrag op hen rustende verplichtingen niet zijn nagekomen en voorts dat zij – met uitzondering van Frankrijk – de krachtens richtlijn 2005/36 op hen rustende verplichtingen niet zijn nagekomen, door deze niet toe te passen op het beroep van notaris.
