The Commission considers that, in the case as it stands, the proposed capital injection constitutes a state aid under the terms of the Treaty because on the one hand, TENEO is a public holding company entirely owned and controlled by Spanish state, and on the other, because on the basis of the information supplied the Commission is unable to conclude that, at present, the proposed injection would provide a private investor, operating under the same conditions and on the basis of a rational decision, prospects of profitability in the longer term.
