Con riferimento all’adeguatezza dello strumento giuridico utilizzato, l’avvocato generale, dopo aver sottolineato le differenze esistenti tra il mandato d’arresto europeo e l’estradizione, considera che l’unica alternativa ad una decisione quadro sarebbe la convenzione internazionale. Ricorda, tuttavia, che il Trattato di Amsterdam ha introdotto la decisione quadro quale nuovo strumento giuridico per superare le difficoltà derivanti dalla ratificazione dei trattati internazionali.
However, he points out that the Treaty of Amsterdam made provision for the framework decision as a new legal instrument intended to circumvent the difficulties arising from the ratification of international treaties. In that connection he emphasises that the Commission, in its proposal for a framework decision, stated that this instrument was chosen for reasons of effectiveness in view of the limited success of the previous conventions.
