In via preliminare la Corte rileva che la causa principale verte su una fattispecie di trasferimento illecito di minore e che, ai sensi del regolamento, il giudice competente, quanto meno al momento della sottrazione della minore, era il Tribunale per i Minorenni di Venezia, giudice del luogo di residenza abituale della minore prima dell’illecito trasferimento.

Il 10 luglio 2009 il Tribunale per i Minorenni di Venezia ha confermato la propria competenza, dichiarando che a suo giudizio non ricorrevano i presupposti per un trasferimento di competenza, e ha rilevato che la consulenza tecnica d’ufficio da esso disposta non aveva potuto essere portata a termine in quanto la madre non aveva aderito al progetto di incontri elaborato dal consulente tecnico d’ufficio.

Notwithstanding the fact that, by an interim judgment issued as a matter of urgency on 8 February 2008 on the application of the father, the Tribunale per i Minorenni di Venezia (Venice Court for matters concerning minors, Italy) prohibited the mother (who had since left the shared home) from leaving the country with the child, Ms Povse and her daughter went to Austria in February 2008, where they have lived ever since.

Vorrei richiamare la sua attenzione anche su un altro problema urgente collaterale a questa discussione: oltre 1 500 minorenni sono stati messi in prigione e saranno giudicati dal medesimo tribunale degli imputati adulti, in stridente contrasto con la Convenzione internazionale sui diritti dell’infanzia.

Detto reato sarebbe stato commesso il 12 marzo 2001 in occasione della deposizione dell'on. Korakas dinanzi al Tribunale di primo grado di Atene nell'ambito di un procedimento avviato dalla moglie separata del querelante, con la quale l'on. Korakas avrebbe avuto una relazione extraconiugale, concernente il versamento degli alimenti mensili ai suoi figli minorenni.
