Questo dovere di esercizio del diritto di avocare a sé la competenza deriva, per l'avvocato generale Trstenjak, da un lato, dall'obbligo degli Stati membri di applicare il regolamento n. 343/2003 in conformità dei diritti fondamentali e, dall'altro, dalla circostanza che un trasferimento dei richiedenti asilo verso uno Stato membro in cui questi rischiano seriamente di subire una violazione dei loro diritti fondamentali quali sanciti dalla Carta dei diritti fondamentali costituisce, in sostanza, a propria volta, una violazione di tali diritti fondamentali da parte dello Stato membro che effettua il trasferimento.
This obligation to exercise the right to assume responsibility arises, in the view of Advocate General Trstenjak, first, from the obligation on Member States to apply Regulation No 343/2003 in a manner which respects fundamental rights. Second, the obligation arises from the fact that the transfer of asylum seekers to a Member State in which there is a serious risk that the fundamental rights guaranteed to them under the Charter of Fundamental Rights may not be respected also constitutes, in principle, a breach of those fundamental rights on the part of the transferring Member State.
