4. Fatto salvo il paragrafo 3, negli Stati membri in cui per l'adozione di taluni tipi di decisioni di cui all'articolo 5 del presente regolamento un'autorità promuove un'azione davanti ad un'autorità giudiziaria separata e diversa dall'autorità responsabile della fase istruttoria, e purché siano rispettate le condizioni del presente paragrafo, l'applicazione dell'articolo 11, paragrafo 6, è limitata all'autorità responsabile della fase istruttoria la quale, laddove la Commissione avvii un procedimento, revoca l'azione promossa davanti all'autorità giudiziaria. Tale revoca è tale da porre definitivamente fine al procedimento nazionale.

4. Notwithstanding paragraph 3, in the Member States where, for the adoption of certain types of decisions foreseen in Article 5, an authority brings an action before a judicial authority that is separate and different from the prosecuting authority and provided that the terms of this paragraph are complied with, the effects of Article 11(6) shall be limited to the authority prosecuting the case which shall withdraw its claim before the judicial authority when the Commission opens proceedings and this withdrawal shall bring the national proceedings effectively to an end.
