La Corte dichiara che, non avendo assicurato, alla data in cui è scaduto il termine impartito nel parere motivato, il riconoscimento dei diritti quesiti agli ex lettori di lingua straniera, divenuti collaboratori ed esperti linguistici di lingua madre, mentre tale riconoscimento era garantito alla generalità dei lavoratori italiani, l'Italia non ha adottato tutti i provvedimenti che l'esecuzione della sentenza 26 giugno 2001, causa C-212/99, Commissione/Italia, comportava ed è quindi venuta meno agli obblighi ad essa incombenti in forza del Trattato CE.
The Court declares that, by not ensuring, at the date of expiry of the period prescribed in the reasoned opinion, recognition of the rights acquired by former assistants who have become associates and linguistic experts, even though such recognition is guaranteed to all national workers, the Italian Republic has failed to take all the measures necessary to comply with the judgment of 26 June 2001 in Case C-212/99 Commission v Italy and has therefore failed to fulfil its obligations under the EC Treaty.
