1. Il curatore dell'insolvenza designato da un giudice competente ai sensi dell'articolo 3, paragrafo 1, oppure il curatore dell'insolvenza o il debitore, in caso di una procedura connessa a un debitore non spossessato nella medesima competenza giurisdizionale, può esercitare nel territorio di un altro Stato membro tutti i poteri che gli sono attribuiti dalla legge dello Stato di apertura, finché non vi è stata aperta un'altra procedura di insolvenza o non vi è stata adottata alcuna misura conservativa contraria in seguito a una domanda di apertura di una procedura di insolvenza in tale Stato.
1. The insolvency representative appointed by a court which has jurisdiction pursuant to Article 3(1) or, in the case of a debtor in possession proceedings in accordance with that jurisdiction, either the insolvency representative or the debtor may exercise all the powers conferred on him by the law of the State of the opening of proceedings in another Member State, as long as no other insolvency proceedings have been opened there nor any preservation measure to the contrary has been taken there further to a request for the opening of insolvency proceedings in that State.
